Buyer Terms

These Buyer Terms supplement the Terms of Service and apply to any organisation, procurement team, EPC contractor, government entity or project owner using ColdMatch Group to identify suppliers of industrial refrigeration, cold storage or cold-chain infrastructure.

1. Eligibility

Buyers must be legal entities (or authorised representatives thereof) empowered to enter into commercial contracts. Individuals acting on behalf of a company must have the authority to submit RFQs and share project information.

2. Independent decision-making

ColdMatch Group provides sourcing, planning, benchmarking and comparison tools to help buyers make informed procurement decisions. All final supplier selection, contract negotiation, technical verification, engineering design, financing decision, logistics arrangement and legal review are the sole responsibility of the buyer.

3. What ColdMatch Group is not

  • Not the manufacturer.
  • Not the equipment supplier or distributor.
  • Not the installer, commissioning engineer or EPC contractor.
  • Not a refrigeration or engineering consultancy.
  • Not a logistics provider, freight forwarder or customs broker.
  • Not an insurer or insurance intermediary.
  • Not a lender, bank, credit provider or regulated financial services provider.

4. Buyer obligations

  • Provide accurate, lawful and complete information in RFQs and account profiles.
  • Perform independent engineering, commercial, financial, tax and legal due diligence before signing any supply, installation or financing contract.
  • Comply with all applicable food safety, refrigerant (F-gas), export, import, customs, sanctions, tax and consumer laws in every relevant jurisdiction.
  • Not use platform data (including supplier lists, pricing, RFQ responses or benchmarks) to compete unfairly with ColdMatch Group, scrape data or build a competing service.

5. No guarantee of price, availability or performance

Quotes, specifications, lead times, warranties and certifications are supplied by third-party suppliers and remain indicative until confirmed in writing by the chosen supplier. ColdMatch Group does not guarantee equipment performance, energy savings, food safety outcomes, installation quality or warranty enforcement.

6. Disputes with suppliers

Any dispute regarding equipment, delivery, installation, warranty, financing or invoicing must be brought against the supplier, EPC contractor, logistics provider, insurer or financing partner that performed or was contracted to perform the relevant obligation.

7. Suspension and termination

ColdMatch Group reserves the right, where appropriate and to the maximum extent permitted by applicable law, to suspend or terminate buyer accounts for breach of these terms, the Acceptable Use Policy, the Marketplace Rules or the AML / Sanctions / Export & Anti-Bribery Policy.
